Journal for 23 June 2010

Prayers were read by the Lord Bishop of Liverpool.

1 Lord Knight of Weymouth The Rt Hon James Philip Knight, having been created Baron Knight of Weymouth, of Weymouth in the County of Dorset, for life by Letters Patent dated 23 June 2010, was introduced between Lord Puttnam and Lord Adonis, made and subscribed the solemn affirmation and signed an undertaking to abide by the Code of Conduct. (See Appendix)

2 Lord Walker of Worcester The Lord Speaker informed the House that Lord Walker of Worcester, a member of the House, had died on 23 June 2010.

3 Leave of Absence Leave of absence was granted to Lord Simon of Highbury for the remainder of this Parliament.

Private Business

4 London Local Authorities Bill [HL] A message was brought from the Commons that they have made the following Order: That the promoters of the London Local Authorities Bill [HL], which was originally introduced in the House of Lords in Session 2007–08 on 22 January 2008, should have leave to proceed with the Bill in the current Session according to the provisions of Standing Order 188B (Revival of bills).

5 Local Government Bill [HL] The Examiners’ certificate that no standing orders relating to Private Business are applicable to the Local Government Bill [HL] was laid on the Table. The Examiners’ certificate and reasons and the minutes of evidence of the examination were ordered to be printed. (HL Paper 12)

Public Business

6 United Kingdom: international competitiveness A question was asked by Baroness Valentine and answered by Baroness Wilcox.

7 Railways: Crossrail A question was asked by Lord Faulkner of Worcester and answered by Earl Attlee.

8 National Health Service: budget A question was asked by Lord Campbell-Savours and answered by Earl Howe.

9 National Health Service: patient targets A question was asked by Baroness Thornton and answered by Earl Howe.

10 Hereditary Peers’ By-election The Clerk of the Parliaments informed the House that Viscount Younger of Leckie had been elected in accordance with the provisions of Standing Order 10 (Hereditary peers: by-elections) to fill the vacancy created by the death of the Earl of Northesk among the peers excepted from section 1 of the House of Lords Act 1999.

11 Hereditary Peers’ By-election The Clerk of the Parliaments informed the House that the Earl of Clancarty had been elected in accordance with the provisions of Standing Order 10 (Hereditary peers: by-elections) to fill the vacancy created by the death of Viscount Colville of Culross among the peers excepted from section 1 of the House of Lords Act 1999.

12 Consolidation etc. Bills The Chairman of Committees moved, in accordance with Standing Order 51, that, as proposed by the Committee of Selection, the following members be appointed to join with a Committee of the Commons as the Joint Committee on Consolidation etc. Bills:

The motion was agreed to and a message was sent to the Commons.

13 Human Rights The Chairman of Committees moved that a Select Committee of six members be appointed to join with a Committee appointed by the Commons as the Joint Committee on Human Rights:

To consider:

(a) matters relating to human rights in the United Kingdom (but excluding consideration of individual cases);

(b) proposals for remedial orders, draft remedial orders and remedial orders made under section 10 of and laid under Schedule 2 to the Human Rights Act 1998; and

(c) in respect of draft remedial orders and remedial orders, whether the special attention of the House should be drawn to them on any of the grounds specified in Standing Order 73 (Joint Committee on Statutory Instruments);

To report to the House:

(a) in relation to any document containing proposals laid before the House under paragraph 3 of the said Schedule 2, its recommendation whether a draft order in the same terms as the proposals should be laid before the House; or

(b) in relation to any draft order laid under paragraph 2 of the said Schedule 2, its recommendation whether the draft Order should be approved;

and to have power to report to the House on any matter arising from its consideration of the said proposals or draft orders; and

To report to the House in respect of any original order laid under paragraph 4 of the said Schedule 2, its recommendation whether:

(a) the order should be approved in the form in which it was originally laid before Parliament; or

(b) the order should be replaced by a new order modifying the provisions of the original order; or

(c) the order should not be approved;

and to have power to report to the House on any matter arising from its consideration of the said order or any replacement order;

That the following members be appointed to the Committee:

  1. L Bowness
  2. B Campbell of Surbiton
  3. L Dubs
  4. L Lester of Herne Hill
  5. B Morris of Bolton
  6. L Morris of Handsworth

That the Committee have power to agree with the Committee appointed by the Commons in the appointment of a Chairman;

That the quorum of the Committee shall be two;

That the Committee have power to send for persons, papers and records;

That the Committee have power to appoint specialist advisers;

That the Committee have power to adjourn from place to place;

That the Committee have leave to report from time to time;

That the Reports of the Committee shall be printed, regardless of any adjournment of the House;

That the evidence taken by the Committee in the last Parliament be referred to the Committee;

That the evidence taken by the Committee shall, if the Committee so wishes, be published.

The motion was agreed to and a message was sent to the Commons.

14 Statutory Instruments The Chairman of Committees moved, in accordance with Standing Order 73 and the resolution of the House of 16 December 1997, that, as proposed by the Committee of Selection, the following members be appointed to join with a Committee of the Commons as the Joint Committee on Statutory Instruments:

  2. L Clinton-Davis
  3. B Eccles of Moulton
  4. E Mar and Kellie
  5. L Rees-Mogg
  6. B Stern

That the Committee have power to send for persons, papers and records.

The motion was agreed to and a message was sent to the Commons.

15 Academies Bill [HL] The bill was further considered in Committee, beginning with amendment 6A. Amendments were considered. The House resumed.

16 Competition Act 1998 (Land Agreements Exclusion Revocation) Order 2010 Baroness Wilcox moved that the draft Order laid before the House on 21 January be approved. After debate, the motion was agreed to.

17 Conduct of Employment Agencies and Employment Businesses (Amendment) Regulations 2010 Baroness Wilcox moved that the draft Regulations laid before the House on 23 March be approved. After debate, the motion was agreed to.

The House adjourned. The House resumed.

18 Academies Bill [HL] The bill was further considered in Committee, beginning with amendment 17A. The House resumed after amendment 29.

The House adjourned at 10.42pm until Thursday 24 June at 11.00am.
