3 Health and Social Care Bill Standing Order 40(1) having been dispensed with, the debate on the amendment to the motion that the bill be now read a second time, to leave out from "that" to the end and insert "this House declines to give the bill a second reading, in the light of the statement in the Coalition Agreement that 'we will stop the top-down reorganisations of the NHS that have got in the way of patient care'.", was resumed. After debate, the amendment was disagreed to (see division list 1) and the original motion was agreed to. Earl Howe moved that the bill be committed to a Committee of the Whole House. Then Lord Owen moved, as an amendment to the motion, at end to insert, "and that a Select Committee shall be appointed to examine and make recommendations to the House on the issues raised by the 18th Report of the Constitution Committee, namely the Government’s and Parliament’s constitutional responsibilities with regard to the NHS, in particular to clarify (a) the extent to which the Secretary of State remains responsible and accountable for the comprehensive health service, and (b) individual Ministerial responsibility to Parliament, and to report on the extent to which legal accountability to the courts is fragmented; that this House requests that the services of Parliamentary Counsel be available to the Committee; and that the Committee shall report no later than 19 December 2011." The amendment was disagreed to (see division list 2) and the bill was committed to a Committee of the Whole House.

8 Protection of Freedoms Bill A bill to provide for the destruction, retention, use and other regulation of certain evidential material; to impose consent and other requirements in relation to certain processing of biometric information relating to children; to provide for a code of practice about surveillance camera systems and for the appointment and role of the Surveillance Camera Commissioner; to provide for judicial approval in relation to certain authorisations and notices under the Regulation of Investigatory Powers Act 2000; to provide for the repeal or rewriting of powers of entry and associated powers and for codes of practice and other safeguards in relation to such powers; to make provision about vehicles left on land; to amend the maximum detention period for terrorist suspects; to replace certain stop and search powers and to provide for a related code of practice; to make provision about the safeguarding of vulnerable groups and about criminal records including provision for the establishment of the Disclosure and Barring Service and the dissolution of the Independent Safeguarding Authority; to disregard convictions and cautions for certain abolished offences; to make provision about the release and publication of datasets held by public authorities and to make other provision about freedom of information and the Information Commissioner; to repeal certain enactments; and for connected purposes was brought from the Commons. 11 Localism Bill The report stage was continued, beginning with amendment 203. Amendment 203L was disagreed to (see division list 3). Amendments were agreed to. The report stage was adjourned.
12 First-tier Tribunal (Immigration and Asylum Chamber) Fees Order 2011 Lord McNally moved that the draft Order laid before the House on 12 July be approved. After debate, the motion was agreed to.
