5 Health and Social Care Bill Lord Owen presented a petition from 38 Degrees, praying that in considering the matter of the NHS risk register, noble Lords remember that risks posed to our NHS by the Health and Social Care Bill are matters of significant public concern. The petition was laid on the Table.

6 Pneumoconiosis etc. (Workers' Compensation) (Payment of Claims) (Amendment) Regulations 2012 Lord De Mauley moved that the draft Regulations laid before the House on 27 February be approved. The motion was agreed to.

7 Mesothelioma Lump Sum Payments (Conditions and Amounts) (Amendment) Regulations 2012 Lord De Mauley moved that the draft Regulations laid before the House on 27 February be approved. The motion was agreed to.

8 Occupational and Personal Pension Schemes (Automatic Enrolment) (Amendment) Regulations 2012 Lord De Mauley moved that the draft Regulations laid before the House on 7 February be approved. The motion was agreed to.

9 Automatic Enrolment (Offshore Employment) Order 2012 Lord De Mauley moved that the draft Order laid before the House on 7 February be approved. The motion was agreed to.

10 Health and Social Care Bill Earl Howe moved that the bill be now read a third time. Then Lord Owen moved, as an amendment to the motion, to leave out from "that" to the end and insert "this bill be not read a third time until the House has had an opportunity to consider the detailed reasons for the first-tier tribunal decision that the transition risk register be disclosed and the Government's response thereto, or until the last practical opportunity which would allow the bill to receive Royal Assent before Prorogation". After debate, the amendment was disagreed to (see division list 1) and the original motion was agreed to. Amendments were agreed to. Amendment 17 was disagreed to (see division list 2). Then Earl Howe moved that the bill do now pass. Then Baroness Thornton moved, as an amendment to the motion, to leave out from "that" to the end and insert "this House declines to allow the bill to pass, because the bill does not command the support of patients who depend on the National Health Service, the professionals who are expected to make it work, or the public; will not deliver the promised objectives of genuinely empowering clinicians in the commissioning process and putting patients at the heart of the system; will increase bureaucracy and fragment commissioning; will allow Foundation Trusts to raise up to half their income from private patients; and, despite amendment, still creates an economic regulator and regime which will lead to the fragmentation and marketisation of the National Health Service and threaten its ethos and purpose". After debate, the amendment was disagreed to (see division list 3) and the original motion was agreed to. The bill was returned to the Commons with amendments.
